William A. Herbert, Deputy Chair and Counsel ![]()
William A. Herbert is Deputy Chair and Counsel and functions as the chief legal advisor to the Chairman and to the Board. Prior to joining PERB, Mr. Herbert practiced labor and employment law for over two decades throughout New York State including representation of clients at PERB as well as in federal and state court. Mr. Herbert is a member of the ABA Labor and Employment Section's Technology in the Practice and Workplace Committee and the New York State Bar Association's Labor and Employment Section's Executive Committee. He has been a contributing editor and contributor for the New York State Bar Association's book Public Sector Labor and Employment Law, Second Edition, and its supplements. In addition, he has published articles in various law journals and lectured at programs on issues including: New York public sector labor law; new technologies in employment; the application of the First Amendment to public employment; employment discrimination; and whistleblower and retaliation issues. Mr. Herbert is a graduate of the Benjamin N. Cardozo School of Law, Yeshiva University and the University at Buffalo.
Anthony Zumbolo, Executive Director ![]()
Anthony Zumbolo moved from the Office of Conciliation to become the Executive Director in September, 2007. During his twenty-five years at PERB, he has mediated more than a thousand collective bargaining disputes and served as the project manager for numerous administrative, research and information technology initiatives, including PERB's web site. He has authored papers for and given presentations to many professional associations, including the American Society for Public Administration and the Labor and Employment Relations Association (formerly IRRA), organizations in which he continues to be an active member. Mr. Zumbolo is a part-time professor at the Nelson A. Rockefeller College of Public Affairs and Policy, University at Albany, the school where he completed his Ph.D. His dissertation was awarded the national Labor and Employment Relations Association's Best Dissertation prize. He also has graduate and undergraduate degrees in economics from SUNY's Albany and Buffalo University Centers.
David P. Quinn, Associate Counsel & Director of Litigation ![]()
Mr. Quinn was appointed to the position of Associate Counsel and Director of Litigation on May 17, 2007. While new to the position, he is not new to PERB, having joined PERB as an Administrative Law Judge in January 1984, a position he held for 15 of the past 23 years; the other 8 as Assistant Counsel for Litigation. He has represented the Board in numerous cases, written hundreds of decisions, and was a contributor to the New York State Bar Association's treatise Public Sector Labor and Employment Law published in 1988. Mr. Quinn received his B.A., cum laude, in 1976 from the State University at Albany where he majored in Social Studies Education. He has an M.A. from the Cooperstown Graduate Programs of the State University at Oneonta in American Folk Culture, and he received a J.D. from Albany Law School in 1982.

Susan A. Comenzo, Assistant Director of Public Employment Practices and Representation ![]()
Susan A. Comenzo has been named PERB's Assistant Director of Public Employment Practices and Representation. A longtime administrative law judge with the agency, Ms. Comenzo is a graduate of the University at Albany and Albany Law School of Union University. Ms. Comenzo has served as an administrative law judge since January 1979. In addition to issuing decisions on improper practice charges, representation petitions, managerial/confidential applications, and declaratory ruling petitions, Ms. Comenzo has been a contributing editor of the New York State Bar Association's treatise Public Sector Labor and Employment Law published in 1988, and its 1993 supplement. She is also the named editor of Taylor Law Remedies by John M. Crotty, and has been a panelist and speaker at local and statewide labor relations programs. She fills a position vacant for a number of years following the retirement of the prior incumbent.
Kevin B. Flanigan, Assistant Director of Conciliation ![]()
Kevin B. Flanigan became PERB's Assistant Director of Conciliation in May, 2007. Since joining PERB in 1982 as a staff mediator, Mr. Flanigan has been instrumental in settling over 1,000 labor-management disputes. In addition to his highly successful mediation experience, Mr. Flanigan has served since 1985 as the principal trainer and facilitator for PERB's Labor-Management Cooperation programs, including Labor-Management Committee Effectiveness, Interest-Based Negotiations, and Facilitated Intensive Negotiations. He has spoken throughout the State on alternative and proactive approaches to dispute resolution and has authored articles on these topics for the University of Illinois, California Public Employee Relations, and the PERB News. A graduate of St. Bonaventure University and the Institute of Labor and Industrial Relations at the University of Illinois, Mr. Flanigan was President of the Capital District chapter of the Industrial Relations and Research Association (now LERA) in 1998-99.

Philip Maier, Chief Regional Mediator in New York City

Philip L. Maier joined PERB in 1991 as an Administrative Law Judge. He has presided over hundreds of cases involving issues such as retaliatory discharge, refusals to bargain, and representation issues. Since 1993, he has been the Director of PERB’s Regional office in Brooklyn and is responsible for overseeing the labor relations which fall within the agency’s jurisdiction in New York City, and Suffolk and Nassau Counties. He continues to serve as an Administrative Law Judge, and also serves as a mediator pursuant to PERB’s impasse resolution procedures. He has mediated numerous collective bargaining disputes in the police, firefighter, and school district arenas. Prior to joining the agency, he served as a litigation attorney with the New York State Labor Relations Board from 1985 – 1991, and graduated with honors from Vermont Law School in 1981, where he was a member of the law review.
Gregory J. Poland, Chief Regional Mediator in Buffalo ![]()
On September 2, 2008, Gregory J. Poland joined PERB as Chief Regional Mediator in Buffalo after eight years as Corporation Counsel for the City of Binghamton and almost three years as General Counsel for a private corporation in upstate New York. He has considerable experience in public sector labor and employment law, including mediation, arbitration, contract negotiations and litigation in State Court. Mr. Poland received his Bachelor’s Degree from Franciscan University, a Masters Degree from SUNY at Cortland and his Law Degree from Widener University School of Law.

Lori Matles, Mediator ![]()
Lori Matles spent several years on PERB's ad hoc panel of mediators and fact-finders after working for nearly ten years as a Federal Mediation and Conciliation Service Commissioner and a number of years before that as a labor relations representative for various organizations. She is a graduate of Northeastern Univeristy and has a M.S. degree in Industrial & Labor Relations from Cornell University/Baruch College. Lori is assigned to the Brooklyn office and spends her time in the Hudson Valley and downstate.

Melanie Wlasuk, Administrative Law Judge ![]()
On August 20, 2007, Melanie Wlasuk joined PERB as an ALJ after spending five and one-half years as General Counsel for Service Employees International Union, Local 200United in Syracuse. She has considerable experience in public sector labor and employment law, including arbitration, contract negotiation, and litigation in state and federal courts. Ms. Wlasuk received her Bachelor's Degree from Syracuse University's Newhouse School of Public Communications, and is a graduate of Syracuse University College of Law.
Nancy L. Burritt, Administrative Law Judge ![]()
Nancy L. Burritt joined PERB on May 2, 2007 as an Administrative Law Judge in the Office of Public Employment Practices and Representation. She has practiced public sector labor and employment law for more than 20 years, including litigation in state and federal courts, as well as appearances before PERB. Ms. Burritt was an adjunct faculty member of the Cornell University School of Industrial Relations, teaching a certificate course in public sector labor law. She received her bachelor's degree from Eisenhower College and is a graduate of Albany Law School.
Kenneth S. Carlson, Administrative Law Judge ![]()
Kenneth S. Carlson came to PERB from the Unified Court System’s Office of Labor Relations where he worked for almost thirteen years, at offices in Albany, Cohoes and New York City. While there he heard grievances and issued written decisions; represented the Court System before PERB and arbitrators; researched State and Federal employment and labor laws; participated in negotiating sessions with all of the Court System’s 12 unions; administered joint labor-management programs; provided a variety of training to court employees, managers and administrators; and assisted court managers and administrators on all aspects of labor relations. He graduated from Albany Law School of Union University, and received his bachelor’s degree from the University at Albany, State University of New York, cum laude, where he majored in history and political science.

Mary Beth Purcell, Administrative Officer ![]()
Mary Beth Purcell has been named PERB's Administrative Officer. Prior to her arrival at PERB, Ms. Purcell was a Classification and Pay Analyst within the Department of Civil Service since 2004. Additionally, she served as the Executive Assistant to the Personnel Council. From 1998 through 2003, Ms. Purcell was a Budget Examiner within the Division of Budget's Transportation, Public Authorities, and Economic Development Unit; Health and Environmental Affairs Unit; and the Budget Services Unit. From 1980 through 1997, Ms. Purcell was employed by the Office of Mental Health as a Budgeting Analyst. Additionally, Ms. Purcell has local government experience and was employed by Albany County Department of Social Services. Ms. Purcell has served as a member and officer of many community boards including the North Colonie Board of Education, the Capital Region Board of Cooperative Educational Services (BOCES), the Colonie Youth Center, the Capital Area School Boards Association, and the Albany County Industrial Development Authority. She is currently the Chair of the Albany County Human Services Advisory Board. She is a graduate of Siena College and has pursued graduate studies at the Rockefeller College and Rensselaer Polytechnic Institute.
